Full Version: Should I Sue?

Ok, before I make the effort to call my lawyer I will put this up to a vote.
But before I do.
I need to give you some background.
For the past 6 months I have been in agony pain everytime I would pee.
I know this is TMI but bare with me.
I went to see a Urologist & a gynecologist
Neither of them had answers.
For 6 long Agonizing months I felt like my Va Va was on fire.
No one had an answer. And in that time I bounced back an forth
from one Dr to another to make sure nothing else was the cause of
this problem. Everything major was ruled out. And still no one had an
answer.
So my last visit, I had with my GYNO he told me to see a
Dermatologist. According to the gyno this was a skin issue and he does not do skin.
I told that to the new
Dermatologist I just saw today and he laughed?
So, anyway. my visit with the new
Dermatologist was futile cause my problems were being healed by
............................ME!!!!!!!!!!!!!!!!!!!!!!
He said keep doing what your doing and in his opinion things were looking better!
And he gave me a script for some other minor skin problems I am having and that was it. Sadly my appt was at a time when my rash was on the mend
Cause, I have been soaking with Domboro solution and using a product called ( (get this) Vitamin A&D ointment (located in the baby isle of all places)
And I swear to dog that Vit A&D ointment was a blessing.
I have had one whole month of pain free, being able to go to the toilet and pee, without it feeling like fire coming out of me.
So, why couldn't any of these doctors tell me to try this before?

It was my Primary care giver DR Z. He was the one who suggested this ointment.
And I plan on making him a very special Thank You card!
When I go see him tomorrow to pick up a refill script.
But this GYNO is another matter.

For 6 months I begged and pleaded with that man to suggest something anything
that I can try to stop the burning.
He said there was nothing he could do for me. He just told me to stop wearing
jeans, which I did, and keep the area clean! NO Like duh! I am just a filthy pig don't you know Sad
And of course I would sadly pay my $10 co-pay and leave empty handed & very pissed.

So, I want to sue this bastard so bad I can taste it.
I bet you any amount of $$ If I was 36-24-36 and 30 years younger he would have been happy to suggest something for me!
But the way he kept looking at me like I was some sort of circus freak
cause of my weight makes me want to sue the shit out of him.

I ask you wouldnt a gynecologist have a working knowledge of a baby product!????
I mean they do deliver babys and tell young mothers what to use.
I mean its out there.
AND it works!!!!!!! But yet he could not suggest that to me.
No, I had to ask my reg DR for advice and humiliate myself in telling him where the problem was.
When he is not an expert in that area either. Yet somehow he knew!
So why didn't the gyno know? I bet that bastard knew!
Soapbox God DAMN these Doctors and there Specializations!
Why can't all doctors know everything about the human body.
I guess that would require too much work from them.
It might take them away from there damn golf course!
ITMT I bet any amount of money that Gyno did know, he just did not want to tell me. Cause all he had was a disgusted look on his face & a condescending attitude towards ME!

But anyway, I was just curious If I had a case of discrimination on my hands.
And should I sue?
I welcome all comments and suggestions.

I think you have an idiot doctor. He's too concerned with the inside parts that he doesn't care about the outside parts. Switch to a woman doctor! No man can understand the pain of urine flowing over a rash in a place you can't bandage, cover, avoid, etc.
On what grounds would you sue? It's not malpractice. He didn't physically harm you or cause you to be physically harmed. As far as you know, you don't have anything fatal or debilitating that he failed to diagnose.

You have no loss of income due to his treatment or lack of treatment. You have not lost the use of any limbs. You have no emotional trauma. No lawyer would take a case like this because there is nothing to sue for.

I do agree he was a jerk though. But he has not done anything illegal.
Scorp's right, there's nothing here to sue over, you have no damages due to any kind of malpractice and you have no proof of discrimination.

I'm confused, why would you see a "Demonologist" for a skin problem?

Sad to say, you guys are right. I have no real PROOF of discrimination.
But if I did, I would go for it.

Thank goodness, I thought your gyn suggested you needed an exorcism!
When you're in that much pain, you'd probably be willing to try anything!

It's very difficult to sue doctors, especially with all the "lawsuit reform" nowadays. Your doctor is a dolt, but he's probably not court material. I read recently that doctors tend to spend more time with young, attractive people since they "identify" with them more (whatever that means).

If you are more than 20 pounds over your "ideal" weight, a lot of doctors tend to get lazy and assume that's the source of whatever's ailing you. Got allergies? Lose weight. Break a finger in the car door? Lose weight. Get poison ivy rash? Lose weight.

I don't trust male gynos to truly grok female issues so when I need a pap smear or my boobs groped, I go to the female PA.
I agree: Switch doctors ASAP.

I'm glad you are on the mend.

Now, if you'd ended up with a near-fatal kidney or bladder infection that could have been avoided, that would be another matter. Fortunately, that's not what happened.

You've got to be kidding, right? Who seriously expects a doctor to know everything there is to know about the human body? Even a specialist has a hard time keeping up with advances in his/her own field, that's why we have subspecialists. Do you know how many hundreds of research papers are published each month in prominent medical journals? If a doctor did nothing but read/study 10 hours a day (which would preclude seeing patients of course), they would still not be able to learn AND remember everything.
That gynecologist would have had to be mighty evil to withold treatment. For physicians the most frustrating thing is to be faced daily with problems for which there is no good treatment; it's hard to imagine someone deliberately refusing to treat you, especially because of your weight.
So, what was the final diagnosis anyway? You describe the typical symptoms of a urinary tract infection, but they should have been able to diagnose that with a simple urine test. What did your primary care provider think this was? Some kind of skin infection? If so, how come it didn't require antibiotics?
I agree the Dr's didn't seem to really care about your problem, but ultimately it is always up to the patient to seek care.

That means going to Dr after Dr to find out what's wrong. It sucks, but this is what happens when Dr's have to see more patients to meet their overhead- patients suffer.

You don't have a life threatening illness that has caused major pain and suffering, and as much as I'd love to see Dr's take responsibility for patient care (I had a family member who was killed because of a Dr. intentionally withholding care) frivolous lawsuits end up raising rates and lowering patient care for *everyone.*

I would love to go back to him and show him that my inner rash is
gone thanks to MY efforts and not HIS!
But, I guess I just have to "let it go" And be grateful that I feel

First off Welcome to the boards CaiqueAficionado & happy posting.
Second off: Yea I know what I said was out of anger more then anything else.
Which is why this was on the Piss & Moan section, lol
I don't really expect all Doctors to know everything about the human body. OMG they would all be still be in school learning, lol But in a "perfect world" wouldn't it be nice if it was possible!
Third off: to answer your question.
I had chonic staph infection. Which according to my OBGYN was more skin related.
I was on round after round of meds. But everytime the meds wore off the symptoms would return. And he refused to give me any more meds. And he told me to go see a skin dr.
So before I did that, I had a chance to talk to my primary care giver. And he said to try some Vit A&D Ointment and that stuff was a life saver for me.
My symptoms stopped and I am much better now.

My beef with the OBGYN was, why couldn't he reccommend that OTC
ointment to me months ago.
It would have saved me 6 months of agony.
Especially when I begged him for ideas of what I can use?
That would be safe in that area of my body.
But, he would sooner spit on me as to help me.
So that was why I really wanted his ass to fry.
Trust me, when it is time for my annual PAP Test
I will switch doctors then.

Not being a dermatologist, he may not have known about it or may not have thought of it.
